Global Law (1028LAW)

Global Law introduces students to the legal systems, traditions and procedures that have importance to Australia but which exist and operates beyond our national jurisdiction and boundaries. In this course you will learn about the basic features of the civil law system and tradition, which in different forms operate in countries like Germany, Brazil, France and Japan. Of particular relevance to Australia's foreign relations is the Chinese legal system and tradition, which has developed out of the Socialist and Confucianist cultural tradition. Knowing some basic things about these other markedly different legal systems will support your learning throughout the law degree and will enable you to become more innovative and entrepreneurial as global lawyers. This will also help you to understand the origins and modes of practice of both private and public international law, which are legal systems that aim to support how people, private entities and States cooperate at the international level. This course will also introduce you to private international law and the way in which people and corporations rely on it to communicate, trade and generally engage with each other globally while ensuring that their transactions are legally secure. Most importantly, this course will introduce you to the basic features of public international law, which is the legal system for ensuring that states like Australia can continue to cooperate and co-exist peacefully with other countries in the world. This course is designed to give you an introductory experience of the range of legal systems and traditions that as global lawyers you need to be aware of and be able to draw on and use as legal advisers or consultants. It also aims to enrich your engagement with other courses in the law degree, so that you can broaden your understanding of the legal and intellectual influences that bear upon Australia's legal system and the people as globally engaged lawyers. Co-requisite: 1031LAW Foundations of Law OR 1011LAW Law and the Modern State. Incompatible: 1012LAW Introduction to Legal Theory.
